A Canadian court has ruled part of a Vancouver city bylaw unconstitutional after it was used to dismantle a protest display. Last year the city used the bylaw to take down a display set up by Falun Gong practitioners near the Chinese consulate. The display had been part of the group’s ongoing protest against the Chinese regime’s persecution of their spiritual practice. Since 2001 practitioners of Falun Gong in Vancouver, Canada have set up banners and a small makeshift hut in front of the Chinese Consulate. The demonstration soon turned into a 24-hour vigil to protest against the Chinese regime’s persecution of the spiritual practice. Last year, the city of Vancouver obtained an injunction to remove the structure, saying it violated a city bylaw that prohibited structures to be built on city streets. The practitioners appealed, arguing their demonstration was a form of political expression protected by Canada’s Charter of Rights and Freedom. On Tuesday, the British Columbia Court of Appeal agreed. In an unanimous decision, the three-judge panel struck down section 71 of the bylaw, saying it is, quote, “of no force and effect insofar as it is inconsistent with freedom of expression.” The court gave the city six months to review the bylaw and city policies. Under the current rules, Falun Gong practitioners can seek approval to rebuild and set up a new protest structure, that is, if the city doesn’t bring in a new bylaw within the six-month period.
