A Canadian court has ruled part of a Vancouver city bylaw unconstitutional after it was used to dismantle a protest display. Last year the city used the bylaw to take down a display set up by Falun Gong practitioners near the Chinese consulate. The display had been part of the group’s ongoing protest against the Chinese regime’s persecution of their spiritual practice. Since 2001 practitioners of Falun Gong in Vancouver, Canada have set up banners and a small makeshift hut in front of the Chinese Consulate. The demonstration soon turned into a 24-hour vigil to protest against the Chinese regime’s persecution of the spiritual practice. Last year, the city of Vancouver obtained an injunction to remove the structure, saying it violated a city bylaw that prohibited structures to be built on city streets. The practitioners appealed, arguing their demonstration was a form of political expression protected by Canada’s Charter of Rights and Freedom. On Tuesday, the British Columbia Court of Appeal agreed. In an unanimous decision, the three-judge panel struck down section 71 of the bylaw, saying it is, quote, “of no force and effect insofar as it is inconsistent with freedom of expression.” The court gave the city six months to review the bylaw and city policies. Under the current rules, Falun Gong practitioners can seek approval to rebuild and set up a new protest structure, that is, if the city doesn’t bring in a new bylaw within the six-month period. This is our fourth country since we started, not including Australia, and we’re excited to be offered a different culture, if only slightly. While Canadians don’t do things all that differently from their southern brethren, there are a few exceptions. I find Canadians a little more courteous and laid back (not to say that the American’s weren’t friendly) but in customer service situations in Canada, we didn’t feel like we were in the way. Also, in Canada they use one and two dollar coins (which the Canadian’s for some odd reason call Looneys and Toonies) instead of dollar notes as in the US. This may seem a small difference, but it really helps in being able to manage your money, especially in being aware of how much you have on your person. There’s also a slight accent difference between America and Canada – Canadian English has definite influences of Scottish and French in it. So even though the variances might be inconsequential, being in Canada allowed us to feel we were venturing into new and undiscovered territory. I ventured out into Kitsilano down to Jericho Beach and walked the several miles of shorefront that blesses Vancouver. Incredible pink sunsets created a magical evening as I watched seals and seagulls who seem nonplussed by the immense tankers and noisy seaplanes passing through the harbor at regular intervals. On a mild fall day, joggers, dog walkers and families stroll through the park that adjoins the driftwood adorned beach, but as dusk falls the strand itself is left to solitary souls and couples. At this time of evening the city is a jagged pearl set amongst the Coastal Range. In the morning with the help of friendly bus drivers, I take the city bus to the False Creek/Chinatown area to see Dr. Sun Yet-San Chinese Gardens. Every inch of the gardens is planned for the harmony of the master as if it were a true Chinese house in ancient times. Each intricate window design has a different meaning, as do the stone patterns on the floor of the courtyards. A serene way to spend a morning. I walk through the downtown area which seems to have a moderate vacancy rate, as I pass several buildings with space for lease.
